Q&A Should we put our business into trust for our daughter?
My wife and I own 14 rental properties, some of which are HMOs. When we passed the official retirement age we decided to put them into a limited company and appoint our daughter and son-in-law as directors and shareholders. Now their marriage is on the rocks and we are concerned what will happen to the business if they divorce and we die. If we restructured the business, could we put it in trust for our daughter?

Please can you advise? I am sole executor of my cousin’s Will. He died last year and getting probate is taking a while. The main beneficiary of his Will was his wife. When he died she was alive and well, but then she died suddenly from an unexpected heart attack a few weeks ago. I am not an executor of her Will. Will the inheritance she would have received from my cousin’s Will now become part of her estate, to be passed on in accordance with her Will?

Read moreQ&A Are bosses discriminating by prioritising leave requests from working parents?
I manage a team of 14 people, several of whom are working parents. It has always been company policy to give priority to working parents when it comes to annual leave requests during school holidays. There is one member of staff, however, who has no children but whose wife works as a teacher. He is a good employee whom I would hate to lose, but he is very angry that he is never allowed to take his leave during school holidays when his wife is off. I have spoken to head office about it, but they are adamant that they are sticking to company policy – no kids, no school holiday leave. Isn’t this discrimination?

My mum moved into a care home following a stroke. She is unable to speak or write but still has mental capacity. I am unhappy with her care and have been fobbed off by the home whenever I have questioned unexplained bruising on her. There have been other things too. I cannot get her moved as there are no nearby vacancies and so haven’t pushed a complaint in case they take it out on her. Now a former employee of the care home has told me things that justify my concerns. Could I bring a negligence claim on Mum’s behalf? If so, what do I need to prove?
