Q&A Is it too late to claim compensation from the military for PTSD caused by Afghan war?

My husband and I were on the brink of divorce, but after having counselling that revealed he is suffering from PTSD I have decided to stay and support him. He served in the armed forces in Afghanistan, finishing his last tour in 2010. Afterwards he was a different person, withdrawn, unstable, prone to violent outbursts over nothing.

Q&A What happens to me and our kids if my partner dies without making a Will?

My partner got divorced 8 years ago before he met me. Due to his marriage failing he does not want to marry again. He also won’t make a Will because he says he is too young. My concern is where would it leave me financially if, for example, he died in a car crash, especially as we have had two young children together?

Q&A Dad says he was pressured by salesman into buying bariatric bed and chair!

My elderly father, who has some mobility issues, contacted a company he saw online advertising bariatric beds and rise and lift chairs and accepted the offer of a home visit. He says he accepted out of curiosity as he knew at the time he could not afford such luxuries. However, the salesman brought a chair for him to try and ‘did a good selling job’ on him. My dad ended up signing on the dotted line, placing an order for a chair and a bed costing just over £8,000, using his credit card. My dad says he felt ‘pressured’ to buy, but nobody was with him to back that up. Is there any way he can get out of the purchases?

It is therefore surprising that few such homeowners are aware of ‘Matrimonial Home Rights’ that could see the incomer having a legal right to remain in the property if the couple split up, even if their name is not on the mortgage or title deeds.

Q&A Has my grandfather’s Will been properly drafted and executed?

My grandfather has died suddenly and I have found a document in his property that looks like a Will. The problem is that it is hand-drafted so I am not sure if it is valid? Also, one of the beneficiaries (my mum) has witnessed the Will. Please can you advise on the validity?

Q&A Would my wife be entitled to benefit from my inheritance when we divorce?

My wife left me last year. We have two sons whom we co-parent half a week each. She did not want to stay in the jointly owned marital home, and somehow managed to get a housing association property in another town near her new partner, although they do not ‘officially’ live together. She does not want a divorce right now, which I suspect is because she hopes I will receive an inheritance before that happens and she thinks she will get half of it in the divorce settlement. Would she be entitled to any of my inheritance?

When you should update your Will and why

Writing a Will is something that all adults should do, and as lawyers we are constantly driving home the importance of doing it at an early age. But whilst more young people are now taking this on board, there is still a danger that once they have done it they will file it away and forget about the need for updating it.
